1. Introduction

Welcome to BlossomCliffWillow ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at blossomcliffwillow.sbs (the "Service") operated by BlossomCliffWillow.

By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. Service Overview

BlossomCliffWillow offers superior yacht charter services which include:

• Daily yacht rentals
• Sunset cruises
• Corporate retreats
• Private events
• Multi-day charters

Availability of all services depends on various factors and we retain the right to adjust or cease services without prior notice.

3. Booking and Reservations

3.1 Booking Process

Booking requirements are as follows:

• Minimum age of 18 years
• Provision of valid and complete details
• Advance payment as indicated in the booking confirmation
• Consent to these Terms & Conditions

3.2 Confirmation

A booking is considered confirmed with payment receipt and our written acknowledgment. We have the right to decline service to anyone at our discretion.

3.3 Availability

Scheduling for charters is contingent on the availability of vessels and favorable weather. We aim to accommodate your preferred scheduling to the best of our ability.

4. Payment Terms

4.1 Pricing

All listed prices are in € and include applicable taxes unless otherwise specified. Prices may be subject to alterations without prior notice.

4.2 Payment Schedule

• Deposit: 50% of the total charter cost due while booking
• Final Payment: Due 48 hours before the charter starts
• Additional fees (if any): Due at the end of the charter

4.3 Payment Methods

We accept most major credit cards, bank transfers, and certified cheques. Payments are processed via secure and encrypted systems.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

• More than 72 hours before departure: Full refund minus processing fees
• 24-72 hours before departure: 50% refund
• Less than 24 hours before departure: No refund

5.2 Weather Cancellations

In cases where the captain deems the weather unsafe, we offer either:

• Rescheduling your charter at no extra charge
• A full refund if rescheduling isn't feasible

5.3 Mechanical Issues

If your designated yacht experiences a mechanical issue, we will strive to provide a comparable alternative. If that's not possible, a full refund will be issued.

6. Safety and Conduct

6.1 Safety Requirements

All passengers are expected to:

• Adhere to instructions given by the crew
• Utilize safety gear when instructed
• Notify us of any medical conditions that might impinge on safety
• Stay within designated areas on the yacht

6.2 Prohibited Items

The following cannot be brought aboard:

• Glass items
• Illegal substances
• Weapons or firearms
• Excessive consumption items beyond reasonable use
• Pets (except with prior approval)

6.3 Conduct

Guest behavior should be respectful at all times. We reserve the right to discontinue a charter prematurely with no refund if behavior is unsafe or disturbs others.

7. Liability and Insurance

7.1 Our Liability

We limit our liability to the charter amount paid. We don't assume responsibility for:

• Injuries caused by passenger negligence
• Personal property loss or damage
• Indirect, consequential, or punitive losses
• Delays from weather or other factors beyond our control

7.2 Insurance Coverage

Comprehensive marine insurance is in place for our vessels and operations. It's recommended that passengers have personal travel and property insurance.

7.3 Assumption of Risk

By using our charter services, passengers acknowledge the inherent risks in marine activities and accept personal responsibility for their safety.

8. Modifications and Itinerary Changes

We reserve the right to adjust itineraries, paths, or schedules due to weather, safety concerns, or operational requirements, providing suitable alternatives whenever possible.

9. Force Majeure

We aren't held accountable for any delay, cancellation, or alteration stemming from uncontrollable circumstances such as:

• Extreme weather
• Natural disasters
• Legal regulations
• Port closures
• Vessel malfunctions

10. Privacy and Data Protection

We process your personal data in compliance with our Privacy Policy. By engaging our services, you agree to the data collection and usage as outlined in the policy.

11. Intellectual Property

Our website content, including text, graphics, and imagery, is legally protected. Reproduction or derivative creation is prohibited without our express consent.

12. Governing Law

These Terms come under the jurisdiction of the laws in Monaco. Disputes, if any, will be resolved in the courts of Monaco, Monaco.

13. Changes to Terms

We may revise these Terms as necessary. Updates will be posted online, marked by the date of revision. Continued service usage will signify acceptance of new terms.
